Terms and Conditions
1. Company Identification
These Terms and Conditions govern the contractual relationship between the client and Saxum Hosting, a business unit of Asterisco Amarelo Lda, VAT no. 517462001, headquartered in Leiria, Portugal.
2. Acceptance
By contracting any service with Saxum Hosting, the client accepts these Terms and Conditions in full, which apply under Portuguese law, European law, and relevant international conventions.
3. Client Obligations
The client agrees to:
Use services only for lawful purposes, in accordance with Portuguese, European, and international law.
Refrain from engaging in unlawful activities such as spam, phishing, malware distribution, copyright infringement, denial-of-service attacks, or any activity that constitutes a crime, offense, or regulatory violation.
Protect login credentials to the client area and assume full responsibility for misuse resulting from negligence.
4. Disclaimer of Liability for Unlawful Acts
Any use of Saxum Hosting’s services for unlawful, fraudulent, or abusive purposes is the sole responsibility of the contracting client.
Saxum Hosting shall not, under any circumstances, be deemed civilly, criminally, or administratively liable for the acts, omissions, or content generated, stored, transmitted, or disseminated by clients through its infrastructure.
In the event of complaints, judicial orders, or investigations by competent authorities, Saxum Hosting may immediately suspend or terminate the services involved, providing only the data strictly necessary to authorities in compliance with applicable law.
5. Limitation of Liability
Saxum Hosting maintains high quality standards but cannot guarantee absolute service continuity. The company shall not be held liable for:
Interruptions resulting from technical maintenance or necessary updates.
Issues caused by third parties, external providers, or force majeure (natural disasters, cyberattacks, global network failures, governmental actions).
Indirect damages, data loss, lost profits, or business disruption resulting from service unavailability.
In all cases, Saxum Hosting’s maximum liability shall not exceed the amount paid by the client for the service during the contractual period in question.
6. Data Protection
All personal data processing complies fully with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679). Saxum Hosting ensures data is collected and processed lawfully, transparently, and limited to contractual purposes.
7. Amendments
Saxum Hosting reserves the right to update these Terms and Conditions, notifying clients with reasonable notice. The client may terminate the contract if they do not accept the changes.
8. Dispute Resolution
Any dispute shall be submitted to the competent courts of Leiria, Portugal, with the option of alternative dispute resolution through the competent Consumer Arbitration Center, in accordance with Portuguese Law no. 144/2015.
